Seventy-year old Ann Prushansky was killed three years ago when a drunken seventeen year old slammed into her car while both were exiting I-95 via the ramp near Boynton Beach. Tara Patrice Fradley was initially charged with DUI manslaughter, amongst other charges, after the accident, but prosecutors dropped the charges because a judge determined the blood tests that determined her blood alcohol content were illegally obtained. According to her attorney, because Fradley did not appear intoxicated after the crash, police were not legally allowed to administer a blood test.
Because the charges were dropped, Prushansky’s three children filed a wrongful death suit against Fradley in civil court. Jurors heard Fradley admit she had been drinking alcohol and consuming Xanax on the day of the crash. Fradley’s attorneys argued that Prushansky would have survived if she had been wearing her seatbelt. The attorney for the Prushansky family responded to the seatbelt allegation, claiming she had been wearing her seatbelt at the time of the crash.
The jury found Fradley responsible for the crash and awarded Prushansky’s children $3 million. The jury also concluded that Prushansky was 25 percent responsible for the accident, reducing the award $750,000, and Fradley will have to pay the family $2.25 million for their mother’s death.
